INSURANCE CLAIMS (HOME, LIFE, DISABILITY)
People buy insurance so that when they need help, they get it. The usual insurance contract provides for the insured to pays premiums to the insurer who in turn protects the insured for their losses or defends the insured from claims made against them. Unfortunately, sometimes things do not work out quite as smoothly we would like.
After an insured has an insurable loss, the insured will report that loss to the insurer. The insurer has three options available to them:
- The insurer can cover the whole loss claimed by the insured;
- The insurer can cover a portion of the loss claimed by the insured; or
- The insurer can deny coverage.
An insurer may only provide partial coverage for multiple reasons; the insurer may claim that the value of the insured’s loss is less than what they are claiming or the insured may be claiming a loss that goes above the monetary threshold provided in the insurance policy. An insurer may deny coverage if the insured is in breach of the insurance policy or if the insured is of the view that the loss suffered is an uninsurable loss.
If the insurer seeks to unfairly value the insured’s loss or refuses coverage altogether, it is within the insured’s rights to dispute the insurer’s decision. This is when hiring a lawyer becomes advisable. A lawyer will aid in interpreting the insurance policy and advise you on the best course of action. The lawyer will take over all communication with the insurer and attempt to make your insurance claim proceed as smoothly as possible.
